We are Fansocial and we are owned by Madlinks Media Ltd at the address of First Floor, 244 Edgware Road, W2 1DS, London.

Please review these Terms and Conditions carefully before using Fansocial.app (“the Website”) as a creator. By registering with us, it is deemed that you have entered into a written agreement with Fansocial.

All About Being a Creator

A creator is someone who creates a page on Fansocial to engage with fans who purchase memberships or offerings on Fansocial to support the creator’s content. There are a lot of details below involving rules, payments, fees and restrictions that you should read in full if you are a creator.

1. Eligibility

To make sure Fansocial is a safe community for everyone, you must be at least eighteen (18) years of age to use the Website as a creator, unless the age of majority in your jurisdiction is greater than eighteen (18) years of age, you agree that you will promptly provide us with the proof of age verification.

2. Intellectual Property

You own everything you post on our website, but we own our text, graphical images, photographs, music, video, software, scripts and trademarks, service marks and logos that we’ve created. Please don’t change, copy, reproduce, or translate them unless we allow you to do so in writing.

Excluding Creator Submissions and Third-Party Content, all other content on the website, including text, graphical images, photographs, music, video, software, scripts, trademarks, service marks, and logos (collectively “Proprietary Materials”), is owned by and/or licensed to us. All Proprietary Materials are subject to copyright, trademark, and other rights under applicable domestic and international laws and conventions. We reserve all rights over our Proprietary Materials.

Except as otherwise explicitly permitted, you agree not to copy, modify, publish, transmit, distribute, participate in the transfer or sale of, create derivative works of, or in any other way exploit, in whole or in part, any Content.

3. How to set Up Your account as a Creator

With our AI-powered KYC process, you can easily set up your account in 5 minutes. To verify your age and identity, you are required to prepare a valid government-issued photo ID, such as a passport, driver’s licence, or national ID card. You need to follow the on-screen instructions to capture clear and legible images of the front and back of the document. You will be asked to take a selfie using their device’s camera and you should follow the on-screen instructions, such as aligning their face within the designated frame and ensuring good lighting.

After completing the document verification and facial recognition, simply click the “Submit” button to send the information for processing. Once the verification process is complete, you will receive a notification regarding the outcome. If the verification is successful, the account opening process will proceed. If you encounter any issues during the verification process or if your identity is not confirmed, you may contact our team to provide alternative identification documents.

4.Creator Submissions

You understand and acknowledge that all uploaded content will be monitored and reviewed by the Fansocial team before publication to ensure it is not illegal and does not otherwise violate our Standards. You acknowledge that if there is a violation in any content,the content will be removed within 24 hours and no reupload is possible.

The unauthorised recording or distribution of intimate images (such as photos and videos that depict explicit sexual activity, nudity, or partial nudity) is a serious violation of our Standards, and is strictly prohibited under our Terms of Service. 

For any of your Creator Submissions, you affirm, represent and/or warrant that:

  1. You own or have the necessary licences, permissions, rights or consents to use and authorise us to use all trademarks, copyrights, trade secrets or other proprietary rights in and to Creator Submissions for any and all uses contemplated by the Website and these Terms;
  2. You will not post, or allow anyone else to post, any material that depicts any individual under the age of eighteen (18) years; and
  3. You have written consent, release, and/or permission from each and every identifiable individual in the Creator Submission to use the name and/or likeness of each and every such identifiable individual to enable use of the Creator Submission for any and all uses contemplated by the Website and these Terms.

You further agree that you shall not submit material that:

  1. Is copyrighted, protected by trade secret or trademark laws, or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have explicit permission from the rightful owner to submit the material and to grant us all of the licence rights granted herein;
  2. Is obscene, vulgar, illegal, unlawful, defamatory, fraudulent, libellous, harmful, harassing, abusive, threatening, invasive of privacy or publicity rights, hateful, racially or ethnically offensive, inflammatory, or promotes or facilitates human trafficking, sex trafficking, or abuse;
  3. Depicts illegal activities, promotes or depicts physical harm or injury against any group or individual, or promotes or depicts any act of cruelty to animals;
  4. Impersonates any person or entity or otherwise misrepresents you in any way, including creating a false identity;
  5. Would constitute, encourage or provide instructions for a criminal offence, a violation of the rights of any party, or that would otherwise create liability or violate any local, state, national or international law; or
  6. Is unsolicited or unauthorised advertising, promotion, “spam” or any other form of solicitation.
  7. promotes or advocates for any political concepts, ideologies, or affiliations. It ensures that the content remains focused on non-political subjects and maintains a neutral or non-partisan stance.

We claim no ownership of Creator Submissions or Third-Party Content. However, we vigorously monitor all content before it is accessible to the public. Content or third-party links will be removed if they are found to violate our policies or if the content offered there is beyond our control or monitoring capabilities (e.g., links to cam sites). Upon receiving a content removal request, the relevant content will be removed within 24 hours.

Furthermore, you irrevocably waive and cause to be waived against us and any of our users any claims and assertions of moral rights or attribution with respect to Creator Submissions.

You represent and warrant that you own the title to the Creator Submissions, that you have the right to upload the Creator Submissions to the Website, and that uploading the Creator Submissions will not infringe upon any other party’s rights or your contractual obligations to other parties.

Without limiting the other indemnification provisions herein, you agree to defend us against any claim, demand, suit or proceeding made or brought against us by a third-party alleging that your Creator Submissions or your use of the Website in violation of these Terms infringes or misappropriate the intellectual property rights of any third-party or violates applicable law and you shall indemnify us for any and all damages against us and for reasonable attorney’s fees and other costs incurred by us in connection with any such claim, demand, suit or proceeding.

5. Anti Modern Slavery Statement

Fansocial is committed to ensuring that there is no modern slavery or human trafficking in any part of our business. We are fully committed to operating responsibly and establishing high ethical standards across our company. We  will not tolerate any forms of slavery, servitude, exploitation or human trafficking in our business through any form.

To ensure all content complies with Fansocial Standards and community guidelines, each submission will undergo a thorough review by our moderators before being published to the public. This process is designed to prevent the dissemination of content that may violate our policies or legal standards. Furthermore, creators must:

Fansocial aims to offer the community an open, safe, and diverse space for an array of expression and preferences. Consent and context are key to distinguishing content that depicts prohibited content, we will immediately remove any content found to violate the present policy. Where appropriate, the creator’s associated account may also be permanently terminated.

7.  Reporting Violations 

GENERAL COMPLAINTS: We invite anybody to report abusive or standards-violating content. Your report will be completely confidential and handled within 7 days of reception. Please use the “Report Button” feature available on the platform. 

CONTENT REMOVAL: We take all requests seriously and will quickly process and remove any content necessary. Should you be the victim of, or come across content that you have personal knowledge of as constituting:

Non-consensual content will be removed within 24 hours, with no need of investigation and  no reupload is possible.

9. PROHIBITED GOODS

The following are strictly prohibited from being sold or otherwise transacted on Fansocial:

Illicit drugs, precursors and drug paraphernalia, firearms and munitions, alcohol and alcoholic beverages, cigarettes (including electronic vaporizers, cigars, human parts, remains and protected flora and fauna, illegal services, counterfeits and any controlled products under applicable law or regulation in the country of buyer or seller, offensive materials and information that is a threat to security of person or state.

For the purposes of the foregoing, a counterfeit is a product that contains words or logos that are identical or similar to a trademark without the authorization of the owner of the trademark.

10. DELIVERY NOTICE

If an order includes multiple items, Fansocial will as far as possible, combine the orders and pack them into one shipment so that you will receive all your items at the same time. Where this is not possible, each item will be shipped individually and have separate delivery dates and shipmentinformation. We will provide you with details of the delivery dates and shipment information by email as soon as your orders are processed. Delivery dates and shipment information are sent per shipment not per item.

11. DELIVERY DELAY

Where there is an unforeseen change in the schedule of the delivery of your order, we will endeavor to inform you by email about the change as soon reasonably possible. Where the delay impacts all or a significant number of orders on Fansocial, we may instead notify you by a notice on the website [or by push notification].

12. PAYMENT AND DELIVERY

You will be immediately notified by email once we successfully receive payment for your order. Depending on your method of payment, there may be a delay between the time when you provided your payment details and when payment was actually received by us.

If you do not receive confirmation of your payment from us within three (3) business days of placing your order, please check that your order was correctly placed before contacting us at [email protected] with details of your order.

You will receive an email upon successful delivery of your order. If you received the notification email but you have not received the order, please immediately check if someone else at the delivery address has received the order on your behalf, check around the delivery location to see if the order was left somewhere discrete and if you are still unable to locate the order, please contact us at [email protected]

13. Third-Party Links

Fansocial App will remove third-party links if they are found to contain content that violates our policies. Additionally, links will be removed if the content provided is beyond the control or monitoring capabilities of Fansocial App, such as links to webcam sites or other similar services.

14. Creator Conduct

You represent and warrant that all the information and content provided by you to us is accurate and current and that you have all necessary rights, power and authority to (i) agree to these Terms, (ii) provide the Creator Submissions to us, and (iii) perform the acts required of you under these Terms.

You hereby expressly authorise us to monitor, record and log any of your activities on the Website, including your chats, streams, messages, interactions with other users and Creator Submissions.

As a condition of your use of the Website:

  1. You agree not to use the Websites for any unlawful purpose or in any way that is prohibited by these Terms;
  2. You agree to abide by all applicable local, state, national and international laws and regulations;
  3. You agree not to use the Websites in any way that exposes us to criminal or civil liability;
  4. You agree that you are solely responsible for all acts and omissions that occur as a result of your use of the Website;
  5. You agree that all your Creator Submissions that you provide to us belongs to you and that you have the right and authority to provide it to us;
  6. You agree to maintain the security of your login password and to be fully responsible for any and all use of your account;
  7. You agree not to use or attempt to use any other party’s account on the Websites without authorization;
  8. You agree not to use any automated means, including robots, crawlers or data mining tools, to download, monitor or use data or Content from the Website;
  9. You agree not to use the Website to collect usernames and/or email addresses for sending unsolicited messages of any kind;
  10. You agree not to take any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on our technology infrastructure or otherwise make excessive demands on it;
  11. You agree not to “stalk” or otherwise harass anyone on or through the Website;
  12. You agree not to forge headers or otherwise manipulate identifiers in order to disguise the origin of any information you transmit;
  13. You agree not to disable, circumvent, or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any content or which enforce limitations on the use of the Website or the content therein;
  14. You agree not to post, link to, or otherwise make available on the Website any material that contains software viruses or any computer code, file or program designed to interrupt, destroy, limit or monitor the functionality of any computer software or hardware or any telecommunications equipment;
  15. You agree not to licence, sublicense, sell, resell, transfer, assign, distribute or otherwise in any way commercially exploit or make available the Website or any Content to any third party;
  16. You agree not to “frame” or “mirror” the Website; and
  17. You agree not to reverse engineer any portion of the Website.
  18. You agree not to use a username of a hateful, racist, defamatory, ethnically offensive nature or any username related to children, terrorist organisation and/or any other sites.

We reserve the right to take appropriate action against any creator for any unauthorised use of the Website, including civil, criminal and injunctive redress and the termination of any user’s use of the Website. Where appropriate, the creator’s associated account may also be permanently terminated.

15. Rules for Creators

16. Payment & Commission

All payouts will be made at the end of each month, regardless of the account creation date. In stage 2, Fansocial will automate the payout process, allowing creators to cash out every two weeks. Payments will be made to creators’ accounts based on their total rollover amount. However, there is a minimum threshold of $200. If the total amount is lower than $200, no payout will be made for that month.

Content creators who join Fansocial during the Beta test period (September 2024 to December 2024) will receive the following percentages of their total income:

Basic-USD19,999.999: 88%

USD20,000 or above: 92%

For content creators who join Fansocial after the launch (January 2025 and onwards), the following percentages will apply:

Basic: 80%

USD3,000-7,999.999: 84%

USD8,000-19,999.999: 88%

USD20,000 or above: 92%

Please note that the dollar amounts and percentages mentioned in the text are hypothetical and may not represent the actual rates offered by Fansocial.

If you earn income from Fansocial, it is advisable to consult with a tax professional or accountant who can provide guidance tailored to your specific situation and the tax laws of your country. In many countries, including the United States, individuals are required to report and pay taxes on any income they earn, including income from online platforms, you’re personally responsible for any tax liability.

Please note that for international wires below USD 500, a handling fee of 30 USD per payout will be charged, while wires above USD 500 will have this fee waived.

17. Privacy Policy

We retain a separate Privacy Policy and your assent to these Terms also signifies your assent to the Privacy Policy. We reserve the right to amend the Privacy Policy at any time by posting such amendments to the Website. No other notification may be made to you about any amendments. Your continued use of the Website following such amendments will constitute your acceptance of such amendments, regardless of whether you have actually read them.

The privacy policy is regulated by the General Data Protection Regulation (GDPR) and the Implementation Act General Data Protection Regulation of the United Kingdom.

18. Safeguard Your Copyright

Fansocial does not allow creators to upload content that infringes upon intellectual property rights, including copyright and trademark. Our community thrives on new and original content, and we ask creators to be sure that they respect others’ legal rights before sharing or uploading content. Publishing or otherwise distributing content for which you do not have authorization is strictly prohibited. 

If you believe that Content uploaded from other creators violate your copyright, please send us a notice of copyright infringement.

All notifications not relevant to us or ineffective under the law will receive no response or action thereupon. An effective notification of claimed infringement must be a written communication to our team that includes substantially the following:

  1. Identification of the copyrighted work that is believed to be infringed. Please describe the work and, where possible, include a copy or the location (e.g., a URL) of an authorised version of the work;
  2. Identification of the material that is believed to be infringing and its location. Please describe the material and provide a URL or any other pertinent information that will allow us to locate the material on the Website;
  3. Information that will allow us to contact you, including your address, telephone number and, if available, your email address;
  4. A statement that you have a good faith belief that the use of the material complained of is not authorised by you, your agent or the law;
  5. A statement that the information in the notification is accurate and that under penalty of perjury that you are the owner or are authorised to act on behalf of the owner of the work that is allegedly infringed; and
  6. A physical or electronic signature from the copyright holder or an authorised representative.

If your Submission is removed pursuant to a notification of claimed copyright infringement, you may provide us with a counter-notification, which must include substantially the following:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. Your name, address, telephone number, email address and a statement that you consent to the jurisdiction of the courts in the address you provided, the United Kingdom and the location(s) in which the purported copyright owner is located; and
  5. A statement that you will accept service of process from the purported copyright owner or its agent.

19. Indemnification 

To the fullest extent allowed by applicable law, you agree to defend, indemnify, and hold harmless this Website, its operator, parent company, affiliates, licensors, service providers, officers, directors, employees, agents, successors, and assigns from any and all claims, damages, judgments, awards, obligations, losses, liabilities, costs, or debts, including but not limited to attorney’s fees, arising from: (i) your use of and access to this Website; (ii) your breach of any provision of these Terms of Service; (iii) your violation of any third-party right, including but not limited to any copyright, property, or privacy right; or (iv) any claim that your Content has caused harm to a third party. This obligation to defend and indemnify will continue even after these Terms of Service end and your use of this Website ceases. You agree that we have the exclusive right and duty to manage the legal defence against any such claims, demands, or litigation, including the choice of counsel and the decision to settle or compromise such claims, demands, or litigation.

20. Disclaimer and Limitations of Liabilities

To the fullest extent permitted by law, the website disclaims all warranties of any kind related to the website and goods or services obtained through the website, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You will be solely responsible for any damage to your computer system or loss of data that results from your use of the website. We make no warranty or representation about the accuracy or completeness of the website’s content or that the website will meet your requirements and assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the website or our services, (iii) any unauthorised access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from the website or our services, (v) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the website or our services by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the website or our services. 

The website does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the website or any hyperlinked services or featured in any banner or other advertising. 

YOU AGREE NOT TO FILE ANY ARBITRATION CLAIM, LAWSUIT OR PROCEEDING INCONSISTENT WITH THE FOREGOING LIABILITY LIMITATIONS ANY CONTENT OBTAINED THROUGH THE USE OF THE WEBSITE IS OBTAINED AT YOUR OWN DISCRETION AND RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH CONTENT.

21. Alternative Dispute Resolution (ADR)

Any dispute, controversy or claim arising out of or relating to these Terms and Conditions, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the Alternative Dispute Resolution Rules applicable in the United Kingdom which Rules are deemed to be incorporated by reference into this clause. The seat, or legal place, of arbitration shall be the United Kingdom. The governing law of these Terms and Conditions shall be the law of the United Kingdom.

22. Governing Law

To the maximum extent permitted by law, these Terms as well as any claim, cause of action, or dispute that may arise between you and us, are governed by the laws of the United Kingdom without regard to conflict of law provisions. FOR ANY CLAIM BROUGHT BY YOU AGAINST US, YOU AGREE TO SUBMIT AND CONSENT TO THE PERSONAL AND EXCLUSIVE JURISDICTION IN, AND THE EXCLUSIVE VENUE OF THE COURTS IN THE UNITED KINGDOM. FOR ANY CLAIM BROUGHT BY US AGAINST YOU, YOU AGREE TO SUBMIT AND CONSENT TO PERSONAL JURISDICTION IN AND THE VENUE OF THE COURTS IN THE UNITED KINGDOM AND ANYWHERE ELSE YOU CAN BE FOUND.

23. Modification of These Terms

We reserve the right to amend these Terms at any time by posting such amended Terms to the Website. No other notification may be made to you about any amendments. 

YOU ACKNOWLEDGE THAT YOUR CONTINUED USE OF THE WEBSITE FOLLOWING SUCH AMENDMENTS WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH AMENDMENTS, REGARDLESS OF WHETHER YOU HAVE ACTUALLY READ THEM.

If these Terms or any other documents between you and us are translated and executed in any language other than English and there is any conflict as between the translation and the English version, the English version shall control.

24. Termination of the Account

By sending an email to [email protected], your Fansocial account will be terminated without further inquiry. If you terminate your account, All the payout and tokens received in your Fansocial account will be transferred to your bank account within 30 working days.
